The warranty will apply in the unlikely event that one of our products falls short on performance, a defect occurs or breakdown that occurs from the manufacturer’s design or factory-installed component parts and systems that breakdown due to flaws or defects found. Please see below the listing of specific ranges and the level of what cover is provided, in all instances all the listings are subject to the terms and conditions. If the product you purchase is proven to be faulty, we may offer a repair, exchange, or credit. Subject to the appliance product listing, the warranty will run from the date of installation, providing the appliance is installed within 6 months of its despatch from Percy Doughty Ltd. The warranty periods listed below only apply when the appliance is purchased from one of our exclusive dealers. This warranty does not include any third-party rights. And during the said periods, this does not include postage, packaging and transportation costs.

The warranty period of the appliance will take effect from the purchase date. During the active period of cover, factoring in the appliance operational time or usage will not hold any bearing on the stated warranty period, neither will it allow the period to be extended in any way. The appliance will only warrant a free repair during the first year, if during the said period, all the terms and conditions are met. The consideration of which will also be inclusive of any pertinent information established as to the nature of the failure or malfunction of the appliance.

Percy Doughty gas appliances are covered by a one-year statutory Parts & Labour, Year 2 Parts only from Percy Doughty when the registration form is completed and returned within 60 days of purchase. Extended warranty not available.

***These exclusions help ensure that the warranty covers only manufacturing defects and not issues arising from external factors or improper use.

  1. Damage from misuse or abuse: This includes damage from improper use, accidents, exposure to harsh chemicals, or physical impacts.
  2. Natural wear and tear: Stains, scratches, water marks, wax from candles, including burns from gas or solid fuel appliances (including burning embers) that may occur from everyday use
  3. Improper installation: Any issues arising from incorrect installation methods(Wrong fixings used or handling by third parties, including sealing or protecting either surface, front and rear.
  4. Environmental factors: Damage caused by structural movements, natural disasters, or extreme weather conditions.
  5. Alterations: Any modifications made to the product after installation, such as changes to the surface finish.
  6. Renovations or Ornament: Any damage caused by future renovations or decoration, including free standing or fixed ornamental statues or seasonal decorative features
  7. Transportation and handling: Damage that occurs during transport, assembly, or disassembly.
  8. Aesthetic preferences: Dissatisfaction based on personal preference regarding colour appearance or texture, or if the product is no longer fashionable

A condition of the warranty states that you must only burn approved fuels when using any appliance or associated flue system supplied by Percy Doughty. Please visit www.hetas.co.uk for a comprehensive list of approved fuels. Fuels outside of this list are not covered by the warranty. Serious damage can occur to the appliance and installation as a whole and the life span of the appliance/installation can be greatly reduced by burning inappropriate fuel-based materials, it may also increase the risk of safety and have a detrimental effect to the environment.

INSTALLATION
The appliance must be installed in accordance with current building regulations and British Standards. British standards and current Gas Safety Installation and Use Regulations 1998. It is a legal requirement that only a Gas Safe Registered engineer can install the appliance if deemed competent to do so. If the installation is in Ireland, then only engineers registered to the Gas Installers of Ireland (RGII) are able to install the appliance if deemed competent to do so. This warranty policy does not cover the installation of the appliance. Any faults and costs incurred as a result due to an incorrect installation resulting in subsequent remedial works would need to be rectified by an independent gas safe registered engineer. All remedial works would need to be completed to the current British standards, building regulations, gas industry installation and use regulations 1998 and in accordance with the manufactures instructions. The cost of all works would be the responsibility of the Consumer and subsequent Percy Doughty fees may also apply.

MAINTENANCE
Routine annual maintenance or cleaning of the appliance is not covered under the terms of this warranty policy and consumers should refer to the appliance instruction manual for details of cleaning and maintenance schedules. Percy Doughty would not carry out work by definition on the appliance due a lack of maintenance. If maintenance was required as identified by Percy Doughty, then a suitably qualified engineer would need to be contacted by the Consumer and all costs which may include fees from Percy doughty would be the responsibility of the Consumer. All work carried out as a result of incorrect maintenance or cleaning methods, including the use of unauthentic, unapproved spare parts by others will be charged by Percy Doughty to the consumer. In the event of unauthentic, unapproved spare parts being used this will automatically void any outstanding warranty period. It is a requirement of the warranty that an annual service on any appliance is carried out by a suitably qualified person registered and deemed competent by an appropriate government regulatory body approved by Percy Doughty.

SITE ACCESS
Visits under this warranty policy are made between 9:00am and 4.00pm on weekdays. It is the responsibility of the Consumer or those made responsible onsite to ensure that the Company or their appointed agent can access the appliance to enable repairs within the agreed timeframe. Abortive calls and/or additional time spent waiting on site will be charged by Percy Doughty to the Consumer.

CHARGES AND PAYMENT
In consideration of the provision of the services by the Company, the Consumer shall pay any applicable charges for the services which are calculated in accordance with the Company’s standard fee rate. All charges quoted to the Consumer shall be inclusive of vat and payment must be received at the time of the visit prior to the repair being carried out.

FORCE MAJEURE
The Company is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service. No party is entitled to terminate this Agreement under such circumstances. If the Company asserts Force Majeure as an excuse for failure to perform the party’s obligation, then the Company must prove that it has taken reasonable steps to minimize delay or damages caused by foreseeable events, that the party substantially fulfilled all non-excused obligations, and that the other party was timely notified of the likelihood or actual occurrence of an event described in the Force Majeure clause.

LIABILITY
The Company’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this Warranty Policy shall be limited to the price paid to the Company by the Consumer for the appliance. The Company shall not be liable to the Consumer for loss of profit, loss of business, or depletion of goodwill in each case whether direct, indirect, or consequential; any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this Warranty Policy will be rejected.

ASSIGNMENT
The Warranty Policy is capable of re-assignment in the event that the consumer sells the appliance within the Warranty Period. The Consumer must inform the Company in writing of such sale within 14 days of relocation / resale; failure to do so will result in the warranty becoming null and void.
The Company reserves the right to reject the request of re-assignment dependent on circumstances and the Company decision will be final.

LAW
This Warranty Policy is governed by the Laws of England, Wales, Northern Ireland and Republic of Ireland and the parties shall submit to the exclusive jurisdiction of the Courts. Statutory rights are unaffected.
